Commissioner Cortese Affirms Deputy’s Dismissal Of Disputed IA Claim

Commissioner Cortese affirmed an arbitration decision in favor of New Hampshire Ins. Co. and their insured employer, represented by BNM attorney Jordan Kaplan. Commissioner Cortese dismissed the claim based on the statute of limitations and held claimant cannot, as a matter of law, file suit against employer/carrier based on an injury that was previously resolved via compromise settlement under Iowa Code section 85.35(3) with the Second Injury Fund.
