On December 6, 2018, attorney Lori Utsinger obtained a favorable summary judgment for her clients in a workers compensation matter.
In the case, the Plaintiff filed a petition alleging a date of injury which was not supported by the medical evidence. Supporting medical evidence showed the correct date of injury. As a result, the Claimant’s petition was untimely per the applicable statute of limitations. Woollums and Utsinger were successful in the motion for summary judgment alleging that the claim was barred by the statute of limitations. The Commission agreed and granted the motion.
